Welcome to Dressable.ai! These Terms of Service ("Terms") govern your access to and use of our AI-powered personal styling platform. By accessing or using Dressable.ai, you agree to be bound by these Terms. If you don't agree to these Terms, please don't use our platform.

1. Acceptance of Terms

By creating an account or using any part of Dressable.ai, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users of the platform, including browsers, customers, and contributors of content.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the platform. Your continued use of Dressable.ai after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 16 years old to use Dressable.ai. By using the platform, you represent and warrant that you meet this age requirement.

If you are using Dressable.ai on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features, you must create an account. When creating an account, you agree to:

• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You may not use another person's account without permission. We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Use of Service

Permitted Use

Dressable.ai provides AI-powered personal styling recommendations to help you discover clothes that fit your body, match your style, and suit your budget. You may use the platform to:

• Complete style quizzes and preference surveys
• Upload photos for AI body measurement analysis
• Browse and save clothing recommendations
• Build and organize your virtual closet
• Create and save outfit combinations
• Track your fashion budget and spending
• Purchase items through our partner retailers

Prohibited Use

You agree NOT to:

• Use the platform for any illegal or unauthorized purpose
• Upload inappropriate, offensive, or illegal content or images
• Violate any laws in your jurisdiction
• Transmit any viruses, malware, or malicious code
• Attempt to gain unauthorized access to any part of the platform
• Use automated tools (bots, scrapers) to access the platform
• Reverse engineer, decompile, or disassemble any part of our technology
• Copy, modify, or distribute our content without permission
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the platform's operation

5. AI Recommendations and Accuracy

Our AI-powered recommendations are based on the information you provide, including your style preferences, body measurements, and shopping behavior. While we strive for accuracy, we make no guarantees that:

• Recommended items will fit perfectly or meet your expectations
• AI-measured body dimensions are 100% accurate
• All product information from retailers is current or correct
• Prices, availability, or product details won't change

Our recommendations are for guidance purposes only. All purchase decisions are your responsibility. We encourage you to check sizing charts, return policies, and product details on retailer websites before making purchases.

6. Virtual Closet and User Content

Items saved to your virtual closet are for organizational purposes only. Dressable.ai does not sell products directly - all purchases are made through third-party retailers.

Your Content

You retain ownership of photos and content you upload. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Process photos for AI measurement analysis
• Store and display content in your virtual closet
• Use aggregated, anonymized data to improve our AI models

You represent that you own or have the rights to upload any content and that it doesn't violate third-party rights or applicable laws.

7. Third-Party Retailers and Purchases

Dressable.ai aggregates products from third-party retailers. When you click to purchase an item:

• You'll be directed to the retailer's website
• Your purchase is subject to that retailer's terms, return policy, and privacy policy
• We are not responsible for product quality, shipping, returns, or customer service
• Prices may change between viewing on Dressable.ai and the retailer's site
• We may earn affiliate commissions on purchases (at no extra cost to you)

All disputes regarding purchases, returns, or refunds must be resolved directly with the retailer.

8. Budget Tracking

Our budget tracking feature helps you monitor fashion spending. However, it's for informational purposes only. We don't have access to your bank accounts or payment information. You're responsible for manually tracking purchases and ensuring accuracy. Dressable.ai is not a financial advisor and provides no financial advice or guarantees.

9. Intellectual Property

The Dressable.ai platform, including all content, features, functionality, software, AI models, design, graphics, logos, and trademarks, is owned by Dressable.ai and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Copy, reproduce, or distribute our proprietary content
• Use our trademarks, logos, or branding without permission
• Create derivative works based on our platform
• Use our AI models or technology for competing purposes

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy. By using Dressable.ai, you consent to our data practices as described in the Privacy Policy.

11. Disclaimers and Limitations of Liability

Service "As Is"

Dressable.ai is provided "as is" and "as available" without warranties of any kind, either express or implied. We don't warrant that the platform will be uninterrupted, error-free, or completely secure.

Limitation of Liability

To the maximum extent permitted by law, Dressable.ai and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Loss of use or business interruption
• Cost of substitute goods or services
• Damages from purchases made through third-party retailers
• Damages from AI recommendations that don't meet expectations
• Damages from data breaches or security issues

Our total liability for any claims arising from your use of Dressable.ai shall not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Dressable.ai and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the platform
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Content you upload or share on the platform

13. Termination

We reserve the right to suspend or terminate your account and access to Dressable.ai at any time, with or without notice, for any reason, including if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account is inactive for an extended period
• We discontinue the platform or certain features

You may also terminate your account at any time by going to Settings > Privacy > Delete Account.

Upon termination, your right to use Dressable.ai will immediately cease, and we may delete your data in accordance with our Privacy Policy.

14. Dispute Resolution

Informal Resolution

If you have a dispute with Dressable.ai, please first contact us at legal@dressable.ai to attempt an informal resolution.

Arbitration Agreement

If informal resolution fails, you agree that any disputes arising from these Terms or your use of Dressable.ai will be resolved through binding arbitration, rather than in court, except:

• You may bring claims in small claims court if they qualify
• Either party may seek injunctive relief in court for IP violations

Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association's rules. You waive your right to a jury trial and to participate in class actions.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any legal action or proceeding related to these Terms shall be brought exclusively in courts located in San Francisco, CA, and you consent to personal jurisdiction in such courts.

16. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dressable.ai regarding use of the platform.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
